“content distribution regulation by viewing user.” Theoretically, if the Kinect establishes there are more people in the room than is permitted according to the licence that users agree to when renting of purchasing content, the movie won’t play.

We all know that Microsoft bombed the XBox announcement but

It is very common for big companies to patent everything because it might become handy when someone “uses” this patent. It is like their second income when business is hard: they sue each other to bankruptcy. I’ve seen some very crazy patents from Apple and Sony but didn’t see any real products out of them.
If there were this kind of DRM it could be exploited by wearing a flat mask (face recognition) and covering the body with a blanket (body detection). Therefore this type of DRM isn’t applicable.
